In Brief...
The sixth annual SIBEC North America forum for the health and
fitness industry took place Sept. 18-21 in the Dallas suburb of Frisco,
TX. More than 60 club leaders from major health clubs met with more than
65 supplier companies from more than 34 categories. At the forum, Katie
Rollauer, the senior manager of research for the International Health,
Racquet and Sportsclub Association, gave an overview on consumers’
attitudes and behaviors about exercise and the health club industry. In
addition, Dave Woodyard, the executive vice president of Club Corp.,
gave a presentation about what to expect in the club industry in the
year 2010.
24 Hour Fitness and KaBOOM!, a non-profit organization dedicated to
bringing play back into the lives of children, are teaming up to build
new playgrounds in Houston communities impacted by Hurricane Ike.
Throughout the month of October, 24 Hour will donate $1 from the monthly
dues of Houston-area members to KaBOOM! to help build the playgrounds.
24 Hour team members, club members and community volunteers will build
the first playground on Dec. 13, with a second playground scheduled for
completion in early 2009.
Life Time Fitness’ real estate business has sold properties in

to pay down debt and will continue to lease the properties it sold to
the buyer, a limited liability company affiliated with W.P. Carey &

The owners of a Lubbock, TX, fitness club and health spa agreed to
an injunction and asset freeze sought by Texas Attorney General Greg
Abbott. Last August, the state charged Extreme Fitness and Wellness
Inc., and its owners, Shon and Desiree Perez, with defrauding its
customers. According to the attorney general’s enforcement action, the
Perezes accepted pre-paid membership dues from about 800 Lubbock-area
residents but never ordered any fitness equipment. The injunction
extends a temporary restraining order that the court granted in August.
Inside
Manufacturers
Perfect Pushup LLC,
designer and distributor of the Perfect Pushup and Perfect Pullup
fitness products, has filed suit against Ontel Products Corp. for claims
involving trademark and copyright infringement. Ontel recently launched
the Iron Gym pullup product on TV. The lawsuit alleges eight causes of
action and claims that Ontel has systematically copied Perfect
Pushup’s products and advertising in an effort to confuse consumers.
Perfect Pushup previously brought an action against Ontel alleging that
the company infringed the Perfect Pushup trademarks with its Pushup Pro
product. The new lawsuit includes claims relating to Ontel’s alleged
failure to perform under an agreement between the parties in the first
lawsuit.
CheckFree, now a part

Strength and Conditioning Coaches Society, have earned distinction. Page

The World Natural Sports Organization (WNSO) is endorsing the
National Federation of Professional Trainers (NFPT) as its athletes’
official training and certification organization. WNSO sanctions
drug-free physique events and holds competitions worldwide. The alliance
provides athletes with the education and certification needed to be
confident in their respective training programs and minimizes the
competitive pressure to take performance-enhancing drugs, according to
WNSO. For more information about WNSO and NFPT events and efforts to
keep drugs out of sports, visit www.fameworldtour.com/WNSO.html.
